Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the EVA mobile application, website, support channels and related services (together, the "Service"). The Service is operated by PROJECT EVA LTD ("EVA", "Energy Vehicle Alliance", "we", "us" or "our").
By creating an account, checking a box to accept these Terms, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
Important: EVA is a technology platform that connects drivers with hosts. Except where we expressly state otherwise, charging is provided by hosts, not by EVA. Please read Sections 1, 8, 15 and 16 carefully.
1. The Service and What EVA Is (and Is Not)
1.1 What EVA provides
EVA is a peer-to-peer marketplace platform that enables:
- Drivers to discover, search, filter, book and pay for access to EV charging facilities listed by hosts;
- Hosts to list chargers, set pricing and availability, manage bookings, communicate with drivers and receive payouts;
- Both parties to use tools such as maps, navigation, messaging, reviews, notifications, optional marketplace listings, and an in-app AI assistant.
1.2 What EVA does not provide
Unless expressly stated in writing:
- EVA is not an electricity supplier, energy broker, utility, distribution network operator, or reseller of electricity;
- EVA does not buy, sell, generate, transmit, distribute or resell energy;
- EVA does not own, operate, install, maintain, certify or inspect hosts' chargers, electrical installations, parking areas or premises;
- EVA does not guarantee the availability, safety, legality, suitability, accuracy or performance of any charger, host, driver, route, price estimate or third-party service.
Electricity consumed during a session is supplied through the host's charger and the host's arrangements with their energy supplier and property. EVA provides software, booking, payment facilitation, communication and support tools only.
1.3 Contracting parties
When you book as a driver, your charging access arrangement is with the host (and your platform use is with EVA). EVA is not a party to the host's supply of electricity or physical access except as platform operator.
2. Definitions
In these Terms:
- "Driver" means a user who books charging sessions through the Service.
- "Host" means a user who lists a charger and offers charging access through the Service.
- "Booking" means a reservation for a charging session for specified date(s)/time(s).
- "Session" means the period during which a driver uses a host's charger in connection with a Booking.
- "Platform Fee" means EVA's fee charged to the driver in addition to the host's session price, as displayed before payment.
- "Host Session Amount" means the amount intended for the host for the charging session, as shown at checkout.
- "Content" means text, images, reviews, messages, listings and other material submitted through the Service.
- "Stripe" means Stripe Payments UK Ltd and affiliated entities providing payment and Connect services.
3. Eligibility and Accounts
3.1 Age and capacity
You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using EVA you represent that you meet these requirements.
3.2 Registration
You must provide accurate, current and complete information during registration and keep it updated. You are responsible for all activity under your account. You must not share login credentials or allow others to use your account.
3.3 Driver and host roles
You may register as a driver, a host, or both. Additional host obligations apply when you list a charger (Section 5).
3.4 Verification and refusal
We may refuse registration, require identity or business verification, or suspend accounts where we reasonably believe information is false, incomplete, fraudulent, abusive or in breach of these Terms.
3.5 Account security
Notify us promptly at support@energyvehiclealliance.com if you suspect unauthorised access. We are not liable for losses arising from your failure to safeguard credentials.
4. Driver Terms
4.1 Accurate information
Drivers must provide accurate account, payment, vehicle and licence plate / registration information where requested. Incorrect vehicle or plate information may affect host access decisions and booking validity.
4.2 Booking in good faith
Book only sessions you intend to use. Do not make speculative, duplicate or fraudulent bookings. Repeated no-shows, late cancellations or abuse may result in suspension.
4.3 Arrival, access and conduct
- Arrive within the booked window (allow reasonable travel time).
- Follow host instructions, access codes, parking rules and site restrictions shown in the app.
- Use the charger only for its intended purpose and in a safe, respectful manner.
- Do not damage property, block access, or leave cables or vehicles in unsafe positions.
- Leave the area in a reasonable condition.
4.4 Vehicle compatibility and safety
You are solely responsible for:
- confirming that your vehicle and cable (if untethered) are compatible with the listed connector and power rating;
- deciding whether charging is safe for your vehicle and battery;
- complying with manufacturer guidance and applicable laws.
EVA does not warrant compatibility. If in doubt, do not charge.
4.5 Payment
You authorise EVA and Stripe to charge your selected payment method for the Host Session Amount, Platform Fee, taxes where applicable, and any cancellation fees or adjustments shown at checkout or under these Terms.
4.6 Communication
Communicate with hosts respectfully through in-app messaging. Harassment, threats, discrimination or abusive conduct is prohibited (Section 14).
4.7 Problems at site
If you cannot access the charger, the equipment appears unsafe, or the session cannot proceed, contact the host immediately via the app. If unresolved, contact support@energyvehiclealliance.com. Do not attempt unsafe workarounds on electrical equipment.
5. Host Terms
5.1 Authority to list
Hosts must own, control or have written permission to make the charger and parking/access available for the bookings they accept. You must not list chargers on land or property where charging for payment is prohibited by law, lease, mortgage, planning, insurance or landlord rules.
5.2 Accurate listings
You must provide accurate and current information including:
- location and address;
- photos that fairly represent the charger and access;
- connector type, charging speed, tethered/untethered status;
- pricing (e.g. per hour), minimum session cost (if any);
- availability calendar;
- access mode (instant book or manual approval);
- arrival instructions (including auto-generated or custom instructions).
Material misrepresentation may result in removal, refunds, suspension and legal action.
5.3 Safety, maintenance and legality
Hosts are solely responsible for:
- electrical safety and compliance with applicable standards and regulations (including periodic inspection where required);
- safe condition of the charger, cable, socket, RCD protection and installation;
- lawful right to offer paid charging at the premises;
- insurance appropriate to hosting (home, public liability, landlord requirements);
- tax registration and reporting of income;
- planning, building control, landlord consent and local authority rules.
EVA does not verify compliance. Listing on EVA does not constitute approval by EVA.
5.4 Honouring bookings
Honour confirmed bookings unless prevented by genuine safety, emergency, equipment failure, unlawful order or circumstances beyond your reasonable control. Promptly update availability if the charger becomes unavailable.
5.5 Manual approval
If you enable manual approval, respond to requests within a reasonable time. Unreasonable delays or arbitrary refusals may lead to account action.
5.6 Pricing
You set your session price within the app's controls. You are responsible for ensuring prices comply with law and any consumer-information requirements. EVA may display suggested pricing or calculators for guidance only.
5.7 Payouts
Host payouts are processed through Stripe Connect. You must complete onboarding and maintain accurate bank details. Payouts are subject to:
- standard schedule — automatic transfers on a recurring basis with a short delay after funds become available (see in-app host help, currently described as approximately every four days);
- instant payout — optional faster transfer for a separate fee (e.g. £0.50) where offered by Stripe;
- Stripe's reserves, verification, chargebacks, disputes and compliance holds.
EVA is not responsible for Stripe delays or declines outside our reasonable control.
5.8 Access instructions and privacy
Provide clear instructions. Do not share driver personal data except as needed for the booking. Comply with data-protection law for information you receive about drivers.
6. Bookings
6.1 Booking types
- Instant book: confirmed when payment succeeds and the app shows confirmation.
- Manual approval: pending until you accept; payment may be captured or authorised as shown in the app flow.
6.2 Confirmation
A Booking is confirmed only when the app displays confirmation (and any required payment step has completed). Calendar availability shown in the app is indicative; conflicts may occasionally occur—contact support if this happens.
6.3 Duration and extensions
Bookings are for the booked window unless the app allows extension or a new booking. Overstaying may incur additional charges or host penalties as shown in the app or communicated by the host.
6.4 Active charging and check-in
Where the app provides check-in, active session or end session features, use them honestly. False check-ins or session manipulation may constitute fraud.
6.5 Vehicle snapshot
We may store vehicle details and licence plate with the booking record for host identification and dispute resolution, as described in the Privacy Policy.
7. Prices, Platform Fees, Payments and Payouts
7.1 Display of prices
Before you confirm a Booking, the app will show, where practical:
- Host Session Amount (host's price for the session);
- Platform Fee (EVA's fee to the driver);
- total payable by the driver;
- minimum session cost or other host rules where applicable.
7.2 Platform Fee
The Platform Fee compensates EVA for operating the Service, including payment processing costs, mapping and routing APIs, hosting, authentication, security, notifications, support, insurance, compliance, development and marketing. The Platform Fee is charged to the driver in addition to the Host Session Amount unless the app expressly states otherwise.
7.3 Host Session Amount
For a completed paid Booking, the host is intended to receive the full Host Session Amount, subject to:
- Stripe Connect onboarding and verification;
- payout timing and schedules;
- chargebacks, refunds, disputes, reserves and compliance deductions;
- taxes and lawful withholdings.
7.4 Payment processing
Payments are processed by Stripe. By paying, you agree to Stripe's terms and privacy policy. EVA does not store full card numbers.
7.5 Environmental contribution
EVA may allocate or contribute an amount equal to 1% of Platform Fee receipts from completed Bookings to tree planting, environmental or sustainability initiatives. This is an EVA platform commitment, not a driver or host donation, and does not create a trust, fiduciary duty, separate fund, tax benefit, or user right to direct or audit those contributions. EVA may modify or discontinue such initiatives for legal, operational or business reasons.
7.6 Price changes
We may change Platform Fees, fee structures or payment flows. Changes apply to new Bookings after notice where required. Confirmed Bookings remain subject to the price shown at confirmation unless correction, refund, dispute or law requires otherwise.
7.7 Chargebacks and disputes
Stripe or card issuers may reverse payments (chargebacks). We may debit host payouts, request reimbursement, or suspend accounts pending investigation. Provide cooperation and evidence when requested.
8. Cancellations, Refunds and No-Shows
8.1 General
Cancellation and refund rules may be shown during booking, in the app, or in host-specific settings. Policies may vary by host and booking stage.
8.2 Driver cancellations
If you cancel:
- refund eligibility may depend on timing (e.g. more than 24 hours before start), host policy, and whether the session has started;
- partial or no refund may apply for late cancellations or no-shows;
- Platform Fees may be non-refundable except where required by law or we decide otherwise.
8.3 Host cancellations
If a host cancels a confirmed Booking or fails to provide access without good reason, the driver may be entitled to a full or partial refund as determined by EVA or Stripe. Repeated host cancellations may lead to account action.
8.4 Charger faults and access failures
If the charger is unsafe, inoperative or inaccessible on arrival:
- contact the host immediately;
- document the issue (photos/messages) where safe to do so;
- contact support promptly.
Refunds or credits may be issued where we reasonably determine the session could not proceed. EVA's decision on platform-assisted refunds is discretionary unless required by law.
8.5 No-shows
Driver no-show: host may retain some or all payment per policy; driver may receive warnings or suspension.
Host no-show / failure to provide access: driver may receive refund; host may receive warnings or suspension.
8.6 How to request help
Email support@energyvehiclealliance.com with booking ID, description and evidence. We aim to respond within reasonable times but do not guarantee outcomes.
9. Reviews and Ratings
After eligible Sessions, users may leave reviews and star ratings. Reviews must be honest, relevant and non-abusive. We may remove reviews that violate these Terms or applicable law. Reviews may remain visible after account closure in anonymised form where permitted.
10. Messaging and User Content
10.1 Messaging
In-app messaging is for booking-related communication. Do not use it for spam, harassment, off-platform payment requests, or unlawful content.
10.2 Your Content
You retain ownership of Content you submit. You grant EVA a worldwide, non-exclusive, royalty-free, sublicensable licence to host, use, reproduce, adapt, publish, display and distribute Content as needed to operate, promote, improve and secure the Service.
10.3 Prohibited Content
You must not submit Content that is unlawful, misleading, defamatory, harassing, discriminatory, infringing, sexually explicit, promotes violence, contains malware, or violates privacy or intellectual property rights.
10.4 Moderation
We may remove Content or restrict accounts without notice where we reasonably believe there is a breach or risk to the Service or users.
11. Marketplace (If Enabled)
If EVA offers a marketplace for goods or services between users:
- listings must be accurate and lawful;
- transactions may be subject to additional rules shown in the app;
- EVA may not be a party to sales between users unless expressly stated;
- disputes between buyers and sellers should be resolved between them first; EVA may assist at its discretion.
12. Subscriptions and Premium Features (If Enabled)
If EVA offers paid subscriptions (e.g. advanced navigation or "EV Pro"):
- pricing and renewal terms are shown at purchase;
- subscriptions may renew automatically until cancelled through Apple App Store settings or as described in the app;
- refunds for subscriptions are subject to Apple policies and applicable law;
- features may change or be withdrawn with reasonable notice where permitted.
13. Third-Party Services
The Service integrates third parties including Stripe, Supabase, Mapbox, Apple, Google (if sign-in enabled), Cloudflare, ChargeTrip or similar routing providers, and AI/LLM infrastructure. Those services have their own terms and privacy policies. EVA is not responsible for third-party outages, errors, pricing, or decisions except as required by law.
Public charging stations shown on the map from third-party data sources are not necessarily EVA host listings. Verify operator terms before use.
14. Prohibited Conduct
You must not:
- Use the Service for any unlawful purpose or in breach of these Terms.
- Circumvent EVA fees or solicit off-platform payment for Bookings made through EVA.
- Create fake listings, bookings, reviews or accounts.
- Harass, threaten, abuse, discriminate against or endanger other users.
- Misrepresent identity, vehicle, charger, availability, pricing or qualifications.
- Interfere with or disrupt the Service (including scraping, overload, reverse engineering except as permitted by law).
- Attempt unauthorised access to accounts, systems or data.
- Use the Service to compete with EVA or copy platform materials without permission.
- Upload malware or infringing material.
- Use charging equipment in a manner that creates unreasonable risk to people or property.
We may investigate violations and cooperate with law enforcement.
15. AI Assistant, Navigation and Routing
15.1 EVA Assistant
The in-app assistant uses automated systems and may access booking and charger context. Responses may be wrong, incomplete or outdated. The assistant does not constitute legal, financial, electrical or safety advice. Always verify critical information in the app before booking, paying or charging.
15.2 Navigation
Turn-by-turn navigation is for convenience only. Follow road laws, signage and safe driving practices. EVA is not liable for routing errors, traffic, road closures or accidents.
15.3 No reliance
You agree not to rely solely on assistant or navigation outputs for decisions affecting safety, payment or legal compliance.
16. Safety Disclaimer
Charging electric vehicles involves inherent risks including electrical shock, fire, trip hazards, and vehicle or battery damage. You use chargers and the Service at your own risk.
EVA does not guarantee that any charger, host, driver, location, instruction, route, availability display, AI response or price is safe, accurate, lawful, suitable or uninterrupted. Stop charging if you observe damage, overheating, unusual sounds or smells, or if you feel unsafe.
In an emergency, contact emergency services first.
17. Intellectual Property
The Service, including software, design, logos, trade marks, text, graphics and compilation, is owned by EVA or licensors and protected by intellectual property laws. You receive a limited, revocable, non-transferable licence to use the Service for personal or internal business use as a host, in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from the Service except as permitted by law or our written consent.
18. Service Availability and Changes
We may modify, suspend or discontinue any part of the Service at any time, including features, fees and geographic availability. We do not guarantee uninterrupted or error-free operation. Planned maintenance and unforeseen outages may occur.
19. Beta Features
We may label features as beta, pilot or preview. They are provided as-is, may change without notice, and may have additional limitations. Your feedback may be used without compensation.
20. Liability
20.1 Nothing excluded unlawfully
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
20.2 Platform role
EVA's role is limited to operating the platform. Hosts are responsible for chargers, premises, electricity supply arrangements, safety, access, pricing, taxes and legal compliance. Drivers are responsible for vehicle suitability, safe use, compliance with instructions and decisions to start or continue charging.
20.3 Exclusion of indirect loss
To the fullest extent permitted by law, EVA shall not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, business, goodwill, data or opportunity, arising from or related to the Service or any Booking, whether in contract, tort (including negligence), statute or otherwise, even if advised of the possibility.
20.4 Specific exclusions
Without limiting the above, EVA is not liable for loss or damage arising from or related to:
- charging activity, electrical equipment, energy supply or consumption;
- host premises, parking, access or instructions;
- vehicle damage, battery degradation or incompatibility;
- fire, electrical fault, personal injury or property damage at a host site;
- charger unavailability, inaccurate listings or third-party map/routing data;
- conduct of hosts, drivers or other users;
- Stripe or payment-provider actions, delays, chargebacks or account holds;
- assistant or navigation errors;
- unauthorised access not caused by our gross negligence;
- events beyond our reasonable control (Section 22).
20.5 Cap on liability
To the fullest extent permitted by law, EVA's total aggregate liability to you for all claims arising from or related to the Service in any 12-month period is limited to the greater of:
(a) the total Platform Fees you paid to EVA in that 12-month period; or
(b) GBP £100.
If you have paid no Platform Fees, the cap is GBP £100.
20.6 Consumer rights (UK)
If you are a consumer, you have statutory rights that cannot be excluded. Nothing in these Terms affects those rights. This Section does not limit mandatory consumer remedies where applicable.
21. Indemnity
You agree to indemnify and hold harmless EVA, its directors, officers, employees, contractors and agents from claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from:
- your use of the Service;
- your Content;
- your breach of these Terms;
- your Booking, Session or listing (including as host or driver);
- your violation of law or third-party rights; or
your charger, property or vehicle (if you are a host or driver).
This indemnity does not apply to the extent a claim arises from EVA's gross negligence or wilful misconduct.
22. Force Majeure
EVA is not liable for failure or delay caused by events beyond our reasonable control, including acts of God, war, terrorism, riots, strikes, government action, epidemics, power failures, internet or telecommunications failures, and third-party service outages.
23. Account Suspension and Termination
23.1 By you
You may stop using the Service at any time. You may request account deletion via in-app settings (subject to resolving active Bookings).
23.2 By EVA
We may suspend, restrict or terminate your account immediately if we reasonably believe you have breached these Terms, created risk or harm, engaged in fraud or abuse, or where required by law or payment providers.
23.3 Effect
Termination does not affect rights and obligations that accrued before termination, including payment, refund, dispute, indemnity and data-retention obligations.
24. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the app, email or website. The "Last Updated" date will change. Continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, stop using the Service and delete your account.
25. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also have rights to bring proceedings in your local courts where mandatory consumer laws allow.
26. Disputes and Complaints
We encourage you to contact us first at support@energyvehiclealliance.com to resolve concerns. We will consider complaints fairly and within reasonable timeframes.
Nothing in this Section prevents either party from seeking urgent injunctive relief.
27. General
27.1 Entire agreement
These Terms, the Privacy Policy, and any booking-specific terms shown in the app at checkout form the entire agreement between you and EVA regarding the Service.
27.2 Severability
If any provision is unenforceable, the remainder remains in effect. The unenforceable provision will be replaced with a valid provision that most closely reflects the intent.
27.3 No waiver
Failure to enforce a provision is not a waiver of future enforcement.
27.4 Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights to an affiliate or successor in connection with a merger, acquisition or sale of assets.
27.5 Third-party rights
No person other than you and EVA has rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms.
27.6 Language
These Terms are written in English. Translations are for convenience only; the English version prevails if there is a conflict.
